HALP! Media - General Competition Terms & Conditions

  1. Introduction

1.1. These Terms and Conditions (“Rules”) govern all competitions, promotions, and campaigns (“Competition/s”) administered by HALP! Media (Pty) Ltd (“the Promoter”) on behalf of its clients.
1.2. By entering any Competition, participants agree to be bound by these Rules, as well as any additional client-specific terms and conditions.
1.3. Participants warrant that they have read, understood, and accepted these Rules.

  1. Promoter

2.1. Competitions are operated by HALP! Media (Pty) Ltd (“the Promoter”) on behalf of various clients (“the Client”).
2.2. The Client may have additional terms and conditions specific to each Competition.

  1. Eligibility

3.1. Competitions are open to legal residents and/or citizens of South Africa unless otherwise stated.
3.2. The following persons may not participate:

  • Employees, directors, agents, or consultants of the Promoter or Client
  • Immediate family members or associates of the above
  • Persons under the age of 18 years
  1. Competition Period

4.1. Each Competition will run for the period specified in the relevant campaign communication or Client’s terms and conditions.
4.2. Entries received after the stated closing date will not be considered.

  1. Entry Mechanics

5.1. Entry into Competitions must be completed in accordance with the instructions provided in the specific campaign.
5.2. Entry methods may include (but are not limited to):

  • Purchase-based entry
  • WhatsApp, SMS, online forms, or social media participation
    3. Participants may enter multiple times where permitted, provided each entry complies with the rules.
    5.4. Incomplete, fraudulent, or corrupted entries will be disqualified.
  1. Prizes

6.1. Prizes will be clearly described in each Competition’s campaign material or Client-specific terms.
6.2. Prizes are not transferable, exchangeable, or redeemable for cash unless otherwise stated.
6.3. The Promoter and/or Client reserve the right to substitute prizes with alternatives of equal value.

  1. Winner Selection & Draws

7.1. Winners will be selected via a random draw or another fair selection method.
7.2. Draw dates, processes, and prize allocation details will be defined in the relevant Client’s Terms & Conditions and made available on the Client’s website or campaign platform.
7.3. Winners will be notified using the contact details provided upon entry.
7.4. Winners may be required to undergo a verification process before receiving a prize.
7.5. If a winner cannot be contacted or fails verification, a replacement winner may be selected.

  1. Winner Announcement

8.1. Winners may be announced on the Client’s and/or Promoter’s platforms.
8.2. By entering, participants consent to their name being published unless they opt out in writing.

  1. Forfeiture & Disqualification

9.1. A participant will be disqualified if they:

  • Provide false or incomplete information
  • Breach these Rules
  • Engage in fraudulent or dishonest conduct
    2. Failure to claim a prize within the specified timeframe may result in forfeiture.
  1. Limitation of Liability

10.1. The Promoter and Client are not liable for:

  • Any technical failures affecting participation
  • Lost, delayed, or incomplete entries
  • Any loss, damage, or injury arising from participation or prize use
  1. Indemnity

11.1. Participants indemnify the Promoter and Client against any claims arising from participation in the Competition or use of prizes.

  1. Right to Amend or Cancel

12.1. The Promoter and/or Client reserve the right to amend, suspend, or cancel any Competition at any time.
12.2. Any changes will be communicated via the relevant campaign platform.

  1. Data Protection & Privacy

13.1. By entering, participants consent to the collection and processing of their personal information for Competition purposes.
13.2. Personal data may be shared with third parties strictly for prize fulfilment and campaign administration, in accordance with POPIA.

13.3 Data Retention & Statute of Limitation

All personal information collected for a Competition will be retained for a maximum period of 2 (two) years after the Competition end date, after which it will be securely deleted or anonymised, unless otherwise required by law.

  1. Consumer Protection Act

14.1. Nothing in these Rules is intended to limit any rights under the Consumer Protection Act, 68 of 2008.

  1. Governing Law

15.1. These Terms and Conditions are governed by the laws of the Republic of South Africa.
15.2. Participants consent to the jurisdiction of South African courts.

  1. Disputes

16.1. Any disputes must be submitted in writing to the Promoter within 14 days of arising.
16.2. The Promoter’s decision will be final and binding.

  1. General

17.1. Each Competition may have additional Client-specific terms and conditions.
17.2. In the event of conflict, the Client’s Competition-specific terms will take precedence.
17.3. These general Terms & Conditions will be available on the HALP! Media website.
